Emily Byrd is an Associate Director at Delta Consulting Group where she works on a variety of matters, including intellectual property (patent infringement, trade dress, and trade secrets) and commercial disputes, false advertising allegations, attorney malpractice, forensic accounting, evaluation of class action certification, and breach of contract.
Emily has more than eight years of experience in professional services in litigation consulting. This includes supporting multiple experts in all phases of the litigation process, including discovery and expert report, deposition, and trial preparation. Specifically, she assisted in organizing and summarizing documentary evidence, drafting expert witness reports, and quantifying economic and financial damages. Additionally, Emily will testifying as an expert in May 2021.
Before joining Delta, she served as a Director at Ankura Consulting.

•Assisted in damages quantification for patent infringement matters relating to several smartphone technologies, televisions and monitor displays, snowmobiles, multiple medical devices, wireless data communication, software technology, mobile phones with cameras and backlit keyboards, mobile bank deposit features, automotive interior zippers, pharmacy dispensing units, online security verification, laser inspecting equipment for aircrafts, semi conductorstorage chips, credit card terminals, telecommunications acceleration and compression of data, and vehicle engine parts.
•Assisted in the evaluation of lost profits and disgorgement damages related to alleged violations of trade defamation and unfair competition relating to construction conduit.
•Provided economic-related analysis for matters regarding a fraudulently filed corporate bankruptcy case and an allegedly violated nondisclosure agreement resulting in unfair trade practices.
•Assisted in the evaluation of claimed lost profits, reasonable royalty damages, and disgorgement measures in matters involving claims of trade dress infringement relating to active sportswear, and mattress patterns; additionally in matters involving claims of theft of trade secrets relating to Direct Physician Care network support systems,pharmacy dispensing units, a geographic survey, and infant feeding products.
•Supported a forensic accounting expert for an insurance company regarding billing fraud and kickbacks by a series of toxicology laboratories. Directed the analysis of dozens of series LLC offerings and millions of investment transactions, including the series’ profits and losses, and distributions.
•Provided incremental profitability analysis and lost earnings analysis in a patent infringement matter relating to gel liners for prosthetic limbs.
•Assisted in providing data analysis and research in breach of contract matters relating to aircraft leasing, pin and socket testing products, cooking products, medical devices, insurance claims,and court reporting school.
•Assisted in preparing financial-related analyses and research information in an antitrust matter in which the employer of helicopter pilots was accused of anti-competitive actions.
•Assisted in the evaluation of claimed lost profits regarding the damages suffered pursuant to alleged violations of the Lanham Act, trade defamation, and unfair competition arising out of alleged unlawful acts in the construction industry, cannabis/hemp market and Direct Physician Care market.
•Assisted in the quantification of damages due to claimed attorney malpractice for an inventor’s patent monetization practice.
•Provided economic research, developed a model for quantifying a patent portfolio’s potential recoverable damages in the mobile payments market, and prepared a presentation related to the solicitation of a law firm and funding partners.
•Provided analytical and surveying assistance in class action matters relating to false advertising of LCD-lit televisions, all-natural beverages, tablets for children, premium pet food, homeopathic cough syrup, joint health supplements, expected vehicle MPG, car battery core fees, and age-correcting makeup.
